Terms of service

1. Who you are agreeing with

These terms are between you and AI with Ash Ltd (a UK company), trading as Fata cu unghiile, the operator of the website fatacuunghiile.ro and related services (together, the "Service"). By creating an account or making a booking you agree to these terms.

2. What the Service does

Fata cu unghiile is a directory and booking platform that connects independent nail artists in Romania with potential customers. We provide the listing, search, messaging, and payment infrastructure. Artists deliver the actual services in their own studios, salons, or at the customer's location.

3. Accounts

You can create an account with your email address. You are responsible for keeping access to that email secure. We will never ask you for a password — sign-in uses one-time codes sent to your email. You may delete your account at any time from your dashboard or by emailing support@fatacuunghiile.ro.

4. Tiers and per-booking fees

Listing as an artist is free. Each plan has a one-off introduction fee charged on the first booking between an artist and a particular client (a flat fee plus a percentage of that booking), and a smaller percentage on subsequent bookings between the same artist and client. A booking is considered "first" if it is the first such booking between that artist and that client processed through the Service. Per-booking fees are deducted from the artist's payout, in addition to Stripe's payment processing fee. Paid plans (Enhanced and Pro) reduce both the introduction fee and the repeat-booking fee, and add features. Plan rates can change with notice; existing bookings keep the rates that applied at the time they were created.

5. Bookings, cancellations, refunds

Customers book and pay through the Service. Artists confirm or decline. Cancellation and refund terms are set per artist (notice required, deposit forfeit on no-show). Disputes between customer and artist are handled by the artist in the first instance; we reserve the right to refund and chargeback at our discretion in cases of fraud, no-show by artist, or misrepresentation.

6. Acceptable use

You agree not to: (a) post discriminatory, abusive, or sexually explicit content; (b) impersonate another person; (c) misrepresent your services or pricing; (d) circumvent the booking system to avoid commission. We may suspend or remove accounts that breach these rules.

7. Payments

Payments are processed by Stripe. By using the Service you also agree to Stripe's Connected Account Agreement. We never store card numbers or bank credentials on our servers — Stripe handles this directly.

8. VAT

Tier subscription prices are displayed inclusive of any applicable VAT. We are not currently registered for UK VAT. From 1 July 2026 EU VAT on subscriptions will be collected and remitted via the EU One-Stop Shop scheme registered in Ireland. Bookings between customer and artist are outside the scope of platform-level VAT — each artist is responsible for their own tax reporting on the services they provide.

9. Liability

The Service is provided "as is". We are not liable for the quality of services provided by independent artists, for missed appointments, or for indirect damages. Our maximum liability is limited to the fees you have paid us in the 12 months preceding the claim.

10. Governing law

These terms are governed by English law. Disputes are resolved in the courts of England and Wales. Romanian and EU consumer protection rights remain available where applicable; consumer disputes can also be referred to ANPC and the EU ODR platform (links in the footer).

11. Changes to these terms

We may update these terms. We'll email you and post a notice on the Service if changes are material. Continued use after a change means you accept the updated terms.
